Terms of Service

Important notice: These Terms of Service (“Terms”) govern your use of the Safety Quest platform and services. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.


1. Definitions

  • “Company” means Safety Quest cc, a close corporation incorporated in South Africa.
  • “Service” means the Safety Quest website, mobile applications, software, tools, templates, and services used to generate, store, and manage contractor safety files.
  • “User” / “you” means any individual or entity that accesses or uses the Service.
  • “Content” means any information, data, documents, text, images, or materials uploaded, generated, or submitted by a User through the Service.
  • “Safety Files” means safety documentation generated using the Service, including but not limited to templates, checklists, registers, and compiled files.

2. Nature of the Service (No Professional Advice)

Safety Quest provides administrative and document-generation tools only.

  • The Service does not constitute legal, occupational health and safety (OHS), engineering, or compliance advice.
  • We do not guarantee that any Safety File generated using the Service will meet the requirements of the Occupational Health and Safety Act, Construction Regulations, client-specific standards, or any other applicable law or contractual requirement.
  • You acknowledge that compliance responsibility remains solely with you, including verifying the accuracy, completeness, suitability, and legal compliance of all Safety Files before use.

You should obtain independent professional advice where required.


3. Eligibility and Account Responsibility

  • You must be at least 18 years old and legally capable of entering into binding contracts.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.
  • You agree to provide accurate, current, and complete information and to keep your account details up to date.

4. Communications

By creating an account, you consent to receive service-related communications. Marketing communications are optional and may be unsubscribed from at any time via provided links.


5. Purchases, Subscriptions, and Billing

5.1 Payments

  • Prices are displayed in South African Rand and are inclusive of VAT, where applicable. The displayed price is the amount you will be charged.
  • By making a purchase, you authorise us (and our third‑party payment processors) to charge your selected payment method.
  • You warrant that you are authorised to use the payment method provided.

5.2 Subscriptions

  • Subscriptions are billed in advance on a monthly or annual basis.
  • Subscriptions automatically renew unless cancelled before the end of the current billing cycle.
  • We may suspend or terminate access if payment fails.

5.3 Free Trials

  • Free trials, if offered, are discretionary and may be withdrawn at any time.
  • Unless cancelled before expiry, paid subscriptions commence automatically at the end of the trial period.

5.4 Cancellation Policy

  • You may cancel your subscription at any time via your account settings or by contacting us through the Service.
  • Cancellation takes effect at the end of the current billing cycle. You retain access to paid features until then.
  • No further charges will be made after cancellation takes effect.
  • Fees already paid for the current billing cycle are not refunded pro rata, except where required by the Consumer Protection Act or as set out in our Refund Policy below.
  • Cancelling during a free trial (see 5.3) stops the paid subscription from commencing, and no charge is made.

6. Refund Policy

  • Refunds are only issued where required by the Consumer Protection Act (CPA).
  • Digital products, including generated Safety Files and templates, are generally non-refundable once accessed or downloaded.
  • Any discretionary refunds are limited to 7 days from purchase and subject to no material use of the Service.

7. Delivery Policy

  • The Service is a digital service delivered electronically. No physical goods are shipped, and no delivery fees apply.
  • Access to the Service is provisioned immediately upon confirmation of successful payment to the email address and account used at sign-up.
  • Safety Files and other documents generated through the Service are delivered digitally within the platform, where they can be viewed and downloaded.
  • If you have paid but cannot access the Service within 24 hours, contact us through the Service and we will investigate and resolve the issue promptly.

8. User Content and Licence

  • You retain ownership of your Content.
  • By submitting Content, you grant Safety Quest a non-exclusive, royalty-free, worldwide licence to host, store, process, and display such Content solely for the purpose of providing the Service.
  • You warrant that your Content:

    • Is accurate and lawful;
    • Does not infringe third-party rights;
    • Is suitable for use in a safety and compliance context.

We do not verify User Content and accept no responsibility for its accuracy or legality.


9. Prohibited Use

You may not:

  • Use the Service for unlawful or misleading purposes;
  • Upload false, forged, or outdated compliance documentation;
  • Misrepresent Safety Files as independently audited or legally certified;
  • Interfere with system security, availability, or performance;
  • Reverse engineer or resell the Service without written consent.

10. Intellectual Property

All intellectual property in the Service (excluding User Content) remains the property of Safety Quest cc or its licensors. No rights are granted except as expressly stated in these Terms.


11. Service Availability and Changes

  • The Service is provided on an “as is” and “as available” basis.
  • We do not guarantee uninterrupted or error-free operation.
  • We may modify, suspend, or discontinue any part of the Service at any time.

12. Limitation of Liability

To the maximum extent permitted by law:

  • Safety Quest shall not be liable for any indirect, incidental, consequential, or special damages, including loss of profits, contracts, data, or business interruption.
  • Our total aggregate liability arising from the Service shall not exceed the fees paid by you in the preceding 12 months.

13. Indemnity

You agree to indemnify and hold harmless Safety Quest cc from any claims, losses, damages, fines, penalties, or legal costs arising from:

  • Your use of the Service;
  • Your Safety Files or Content;
  • Any regulatory non-compliance, site incident, injury, or audit failure.

14. Data Protection (POPIA)

  • We process personal information in accordance with the Protection of Personal Information Act (POPIA).
  • You warrant that you have lawful grounds to upload any personal data to the Service.
  • Further details are set out in our Privacy Policy.

15. Termination

We may suspend or terminate your account immediately if you breach these Terms or misuse the Service. Upon termination, access to stored Content may be limited or deleted subject to legal retention requirements.


16. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. The courts of South Africa shall have exclusive jurisdiction.


17. General

  • Force Majeure: We are not liable for delays or failures beyond our reasonable control.
  • Assignment: You may not assign these Terms without our consent.
  • Severability: Invalid provisions do not affect the remainder.
  • Entire Agreement: These Terms constitute the entire agreement between the parties.

18. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance.
